California has some of the most stringent laws for impaired driving in the country. There are two separate misdemeanor offenses in the California Vehicle Code Section 23152.

Vehicle Code Section 23152(a) VC prohibits any person to drive a vehicle under the influence of alcohol or drugs or both.
California Vehicle Code Section 23152(b), indicates a "per se" BAC limit of .08%ā, and a lower limit of 0.04% for drivers holding commercial drivers licenses.
